Sometimes getting the perfect shot is not worth the risk. This tragic accident may have been avoided had the young man proceeded with caution. With all of the challenges photographing in NYC (harrassment from police, getting into fights for taking someone's photograph, etc.), you must always know your surroundings.

A New York City cop is charged tonight with driving drunk and killing a man.

Investigators say he was off-duty when he drove down a blocked lane on the 59th Street Bridge and ran down a man taking pictures.
Eyewitness News reporter Marcus Solis has the story from the scene.

Friends of the victim were too upset to speak on camera, but they describe Julio Ortega as a gifted photographer. It was Ortega's passion for the art form that led him to the Queensboro Bridge early this morning. The 31-year-old was taking pictures of steam rising above the city skyline when he was hit by a car and killed.

Police say that car was being driven by an off-duty cop who was drunk. Brandon Colon who has been on the force for five years is now under arrest.
